Data and AI Policy

This policy explains how My Life Spark P.C. handles data across Life Spark Survivorship Institute and how artificial intelligence features are governed. It supplements the Privacy Policy.
What data are collected
- Account and role data.
- Content entered into tools, trackers, planners, and templates.
- Usage logs, platform metrics, and experiment assignments.
- Device and browser information.
- Support, feedback, and attestation records.
- Payment metadata and receipt records.
Why they are collected
- To operate, secure, and support the Platform.
- To deliver the features and downloads a user requests.
- To measure feature performance and improve products.
- To meet legal, audit, and record-keeping obligations.
- To conduct validation, workflow, and implementation studies where permitted.
Who may receive them
- Authorized My Life Spark P.C. personnel with a legitimate need.
- Service providers bound by contractual confidentiality and, where applicable, business associate agreements.
- Payment processors for transaction handling.
- Regulators, auditors, or courts where legally required.
- Recipients of aggregated or de-identified datasets that do not identify an individual.
My Life Spark P.C. does not sell personal information.
How long they are retained and when they are deleted
- Data are retained for as long as needed for the purpose collected.
- Account content is deleted on request, subject to legal retention obligations.
- Logs and security events expire on a rolling schedule.
- Financial records follow statutory retention periods.
- Backups age out according to the backup rotation schedule.
How they are secured
- Encryption in transit and at rest.
- Role-based access control and least-privilege provisioning.
- Audit logging of privileged actions.
- Multifactor authentication where required.
- Monitoring of security events and investigation of misuse.
How aggregated datasets are created
- Direct identifiers are removed before aggregation.
- Records are combined so that individuals and organizations are not identifiable.
- Small-cell suppression is applied where a group is too small to protect.
- Aggregated datasets may be used for validation, benchmarking, publication, and product improvement.
- Re-identification attempts are prohibited.
Artificial intelligence
- AI outputs are informational.
- Users remain responsible for independent judgment.
- AI may generate inaccurate information.
- Outputs require professional review.
- AI continually evolves.
AI features may be used to draft, summarize, classify, or organize content. Outputs are informational and must be reviewed by a qualified professional before being relied upon in clinical, legal, financial, or operational decisions.
Data
The Data and AI Policy explains each of the following.
- What data are collected.
- Why they are collected.
- Who may receive them.
- How long they are retained.
- How they are secured.
- When they are deleted.
- How aggregated datasets are created.
Privacy
My Life Spark P.C. provides disclosures regarding each of the following.
- Information collected.
- Cookies.
- Analytics.
- Platform metrics.
- Device information.
- Usage logs.
- Communication preferences.
- Security practices.
- Retention periods.
- Deletion requests.
- International users.
Security
My Life Spark P.C. reserves the right to:
- suspend accounts
- investigate misuse
- terminate suspicious activity
- monitor security events
- require multifactor authentication
- modify security controls
Research
Research participation is separate and distinct from ordinary use of the Platform. Ordinary Platform use is governed by the Platform Terms of Use and does not constitute research participation.
- Research participation is voluntary.
- Users may decline research.
- Declining research does not affect ordinary platform use, unless complimentary access specifically requires designated feedback activities.
- Informed consent may be required.
- Additional research agreements may be required.
- IRB requirements will be followed whenever applicable.
- Publications may use aggregated or de-identified information.
- Identifiable information may require additional authorization.
Publications
My Life Spark P.C. may:
- publish aggregated findings
- publish de-identified analyses
- publish software validation
- publish workflow studies
- publish implementation studies
- No participant identity will be disclosed without permission.
- No organization will be identified without permission.
- Authorship remains under My Life Spark P.C. control unless separately agreed in writing.
Intellectual property
My Life Spark P.C. owns exclusively, and retains all right, title, and interest in and to, the following:
- software
- source code
- object code
- algorithms
- artificial intelligence systems
- prompts
- workflows
- templates
- databases
- taxonomies
- educational materials
- presentations
- demonstrations
- recordings
- reports
- graphics
- visualizations
- branding
- documentation
- APIs
- analytics
- improvements
- derivative works
- training materials
- methodologies
- trade secrets
Nothing in this agreement, and nothing arising from use of the Platform, transfers ownership of any of the foregoing. All rights not expressly granted are reserved by My Life Spark P.C..
Feedback
If you provide feedback, suggestions, ideas, requests, bug reports, or comments, you grant My Life Spark P.C. permission to:
- review feedback
- analyze feedback
- aggregate feedback
- improve products using feedback
- create derivative works from feedback
- incorporate suggestions into future products
- commercialize improvements derived from feedback
You receive no ownership interest and no royalty in connection with any feedback or with any product, improvement, or derivative work arising from it.

- Educational content is informational.
- Platform content does not establish physician-patient relationships.
- Platform content does not constitute legal advice.
- Platform content does not constitute accounting advice.
- Platform content does not constitute investment advice.
- Users remain responsible for independent decisions.
Warranties
To the fullest extent permitted by applicable law, the Platform, all services, all content, and all materials are supplied on an "as available" and "as provided" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
Limitation of liability
To the fullest extent permitted by applicable law, My Life Spark P.C. and its affiliates, officers, clinicians, employees, contractors, and agents shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or relating to the Platform or these terms. Damages are limited to the fullest extent permitted by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless My Life Spark P.C. from claims arising from:
- use
- misuse
- unlawful conduct
- infringement
- violation of agreements
- misuse of data
Termination
My Life Spark P.C. reserves the right to terminate:
- accounts
- complimentary access
- event registrations
- working-group participation
- research participation
Effect of termination
Termination ends:
- licenses
- complimentary access
- downloads not previously authorized
- future participation rights
Intellectual-property protections, confidentiality obligations, payment obligations, dispute-resolution provisions, and limitation-of-liability provisions survive termination.
Dispute resolution
Disputes proceed through a three-step cascade. First, good faith negotiation between the parties. Second, confidential mediation. Third, confidential binding arbitration.
- Good faith negotiation: the parties will confer directly and attempt to resolve the matter for a period of thirty days after written notice.
- Confidential mediation: if negotiation does not resolve the matter, the parties will submit it to confidential mediation before a mutually selected mediator.
- Confidential binding arbitration: if mediation does not resolve the matter, it will be finally resolved by confidential binding arbitration before a single arbitrator.
- The parties waive any right to a trial by jury.
- The parties waive class actions and class arbitration to the extent permitted by law.
- Proceedings may be conducted remotely, virtually, and asynchronously where appropriate.
No court proceeding and no jury trial is permitted, except for actions to compel arbitration or to enforce an arbitral award, and except where applicable law does not permit waiver.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles, My Life Spark P.C. being the contracting entity.
General provisions
- Entire agreement: this document, together with any document it expressly incorporates, is the entire agreement between the parties on its subject matter.
- Amendment only in writing.
- Electronic signatures and electronic acceptance are valid and binding.
- Severability: if a provision is unenforceable, the remainder continues in force.
- No waiver: failure to enforce a provision is not a waiver of it.
- Assignment: you may not assign without written consent; My Life Spark P.C. may assign freely.
- Force majeure: neither party is liable for delays caused by events beyond reasonable control.
- Notices: notices may be delivered electronically to the contact address on file.
- Export-control compliance applies where applicable.
- Sanctions compliance applies where applicable.
- Survival: provisions that by their nature should survive, survive.
- Headings are for convenience and do not affect interpretation.
- Interpretation: no rule of construction against the drafter applies.
- Counterparts apply where signed agreements are used.
